A PROFESSIONAL CORPORATION
Michael G. Kim Law serves clients in San Diego, Orange, Riverside and Imperial Counties since 1991.
With Michael G. Kim Law, the client’s interests come first, always. We counsel clients in successfully navigating risk, whether through aggressive litigation, advocacy, negotiation or implementing appropriate legal architecture. Our advice and legal products are based on client objectives applied to the facts, law and economics of the particular situation, their implications and how they are likely to impact the client in the future. At all times, we are focused on the big picture, and maximizing the client’s bottom line economic and practical result. Consequently, our clients stay with us, and the majority of our business is referred.
Michael G. Kim Law specializes in common interest development law and serves as full-service legal counsel to homeowners associations throughout Southern California. Since 1991, we have represented clients as trial counsel in civil lawsuits, many of them high exposure construction and business litigation cases resulting in millions of dollars in verdicts and settlements for our clients. We represent builders and investors in real estate development, land use and disclosure matters. We also provide general civil legal services, representation in alternative dispute resolution proceedings such as mediation and arbitration, draft trusts and wills, and provide fiduciary services such as serving as trustee, administrator, guardian or conservator.
Michael G. Kim Law is a full service HOA law firm providing general counsel, governing document amendment, assessment collection, rules enforcement and litigation legal services to our clients. We create governing documents for builders, provide land acquisition and subdivision approval legal services, and represent real estate investors in transactional, land use and disclosure matters.
Since 1991, we have represented clients as trial counsel in lawsuits of virtually every civil category, including construction defect, business litigation, contract and governing document enforcement, breach of contract, real property, insurance, regulatory compliance, medical malpractice, personal injury, and equitable claims and petitions such as writs, injunctions, declaratory relief and receiverships. We also represent clients in alternative dispute resolution proceedings such as mediation and arbitration.
We draft trusts and wills for small to medium sized estates, and provide fiduciary services such as trust administration, and serving as trustee and executor. We have been appointed as a guardian and conservator by the San Diego Superior Court and we represent clients in trust modification and litigation proceedings.
“I have worked with Michael on developer litigation as well as CC&R litigation issues and in each case obtained an excellent result. He is a professional as well as respected in the legal community.”
Bob Mann – Brookhills HOA, Fallbrook
“Michael Kim helped our HOA navigate through rough waters. His vast experience in home owners association law, as well as his wisdom and calm demeanor provided our board with professional and caring counsel.”
John Trifiletti, Chateau Girard Condominium Association, La Jolla
“Condo owners in two buildings within the gates of the Omni La Costa Resort & Spa (represented by Michael Kim) can continue using them as short-term vacation rentals . . . On a rare 3-2 vote, the council amended an ordinance it passed last year that had limited vacation rentals to the city’s coastal zone.” Mr. Kim’s successful advocacy on behalf of the 96 condo owners that resulted in the City of Carlsbad amending its short-term vacation rental ordinance to exempt the condos restored millions of dollars in equity in the condos since they had historically been valued by the market for their short-term rental value. “I have served two terms as president of the Brookhills HOA during a period when the homeowners were engaged in a lawsuit with the developer. I worked very closely with Michael and we were able to reach a very satisfactory settlement – one that would not have been possible without his constant and valuable participation. I highly recommend his firm.”
Jeff Graflund – Brookhills HOA, Fallbrook
“Mike was the lead attorney on a developer law suit, and I the HOA director. Attitude and character won us over, and now he serves as counsel for two associations I serve on.”
